Mocatree Cash Policy

1. PURPOSE
This Goldwing Cash Policy(hereinafter referred to as "Cash Policy") the necessary matters members ( hereinafter referred to as “User”) should acknowledge and understand while using the paid services provided by Mocatree (hereinafter referred to as “Company”) .
2. DEFINITIONS
(1)The definitions of terms used in Cash Policy are as follows.
  • 1) ① "Service" means games and other services provided by the company to members.
  • 2) ② "Goldwing Cash" means the virtual currency which can use or purchase items in game.Members can use to pay fees or make purchases.
  • 3) ③" Event Type Goldwing Cash" means Goldwing cash that was paid for free in events. Goldwing Cash for event can be used within the validity period set by the company.
  • 4) ④ "Charge" means the purchasing action of Goldwing Cash made by Users using the payment method specified by the Company.
  • 5) ⑤ "Purchase" means the act of purchasing items, avatars or paid services provided by the company, etc. by Users using charged Goldwing cash or other payment method.
  • 6) ⑥ "Refund" means the act of returning the amount in cash that paid by the charged Goldwing Cash or other payment method according to the refund policy set by the company.
  • 7) ⑦ "Paid service(s)" means any purchased online content within the game services by Users using the payment method specified by the Company..
    • a. Subscription service : A service that can be used for a period corresponding to the fee by paying a fee set in advance by the company based on a certain period.
    • b. Paid Content(s) : It means any purchased online content(Items, Avatar, the other paid contants) within the Game Services.
(2) The definitions of the terms used in these Cash Policy shall be based on the relevant laws and regulations except as set forth in Paragraph 1, and the matters not set forth in these Cash Policy shall be governed by general commercial practices.
3. TERMS AND AMENDMENTS
(1) The Company publishes the Cash Policy on the home page or the linked page through the initial page so that the Member can easily understand the contents of the Cash Policy.
(2) The company may revise its Cash Policy that it does not violate related laws such as " the Consumer Protection Act ", "the Regulation of Terms and Conditions", "he Game Industry Promotion Act", "the Information and Communication Network Utilization and Information Protection Act" ,and " the Content Industry Promotion Act ".
(3) In the event of the amendment of the Cash Policy, the Company shall announce the effective date, the details of amendment, the reason for the amendment on the initial page or link page 7 days before the applicable date. However, any unfavorable or significant changes to the terms and conditions shall be announced 30 days prior to the effective date, and members shall be notified of the terms and conditions to be amended, effective date and reasons for amendment by initial page or link page.
(4) If the company revises the Cash Policy, check whether the member agrees to apply the revised Cash Policy after it is announced. The Company may be able to deem the Member to have agreed to the Amended Cash Policy if Member does not express any sign of consent or rejection by the effective date.
(5) If the user does not agree with the terms of the Cash policy, the company or the user may terminate the terms of use of the service.
4. NON-POLICY RULES
(1)Matters not specified in these Cash Policy or interpretation thereof shall be governed by Term of service or other policies prescribed by the company.
(2) Other matters not specified in the policies or terms and conditions prescribed by the company shall be governed by relevant laws such as the Consumer Protection Act in Electronic Commerce, the Regulation of Terms and Conditions, the Game Industry Promotion Act, the Information and Communication Network Utilization and Information Protection Act, etc.
5. RECHARGING OF GOLDWING CASH
(1) Goldwing Cash charging and paid service are only available to users who have authenticated themselves.
(2) When charging Gold Wing Cash, you can additionally register payment information related to charging for convenience.
(3) Goldwing Cash can be recharged within the maximum limit for each charging unit and period set by the company's policy.User's recharge limit may be applied differently for each member depending on the member's status and member's request. In addition, the company may limit the amount that can be recharged using specific payment methods.
(4) When a member charges with a specific payment method, it is deemed that User has agreed to the terms of each payment agency that provides the payment method, and the limit for charging will also follow the standards set by each payment agency.
6. THE USAGE AND EXPIRATION OF GOLDWING CASH
(1)Goldwing Cash can be used as a payment when purchasing paid services provided by the company.
(2) Goldwing Cash recharged by members will expire according to the commercial statute of limitations when 5 years have elapsed from the date of last use.
(3) The usage period of the event type Goldwing Cash may have some difference according to the policy set by the company (notified on the event page). After the usage period has passed, you cannot use the event type Goldwing Cash you received.
(4) When using the Goldwing Cash, it will be used for payment at first priority. However, this is not the case if a separate usage priority is specified in the service.
(5) When charging or using Goldwing Cash, the amount used may be limited according to the policy set by the company.
7. THE RESTRICTION OF USE
(1) The company may not accept any of the following applications for approval of payment, cancel the approval afterwards, and restrict the use of various services.
  • ① In the case of the payment is not made or the payer cannot be verified,
  • ② In the case of another person's payment information is stolen.
  • ③ In case of performing an act prohibited by related laws, such as making payment in an abnormal way.
  • ④Other cases deemed inappropriate for approval of payment for the same reasons as in paragraphs 1 through 4.
8. WITHDRAWAL OF PAID CONTENT
(1)The company's paid services are divided into products that can be withdrawn and products that cannot be withdrawn, and these details are notified on the transaction screen when a member purchases a paid service. Users who have signed a contract with the company on the use of paid services may withdraw the subscription within 7 days from the date of purchase or the date of availability of the paid service.
(2) Members may not withdraw their subscription pursuant to paragraph (1) against the will of the company in any of the following cases.
  • ① In the case where goods, etc. are lost or damaged due to reasons responsible to the user.
  • ② In the case that user already used or partially used goods.
  • ③ If it is difficult to re-sell after time passes
  • ④ In the case of damaging the packaging of reproducible goods, etc.
  • ⑤ When the provision of digital contents under subparagraph 5 of Article 2 of the 「Cultural Industry Promotion Act」 is started. However, in the case of a contract consisting of divisible digital content, this is not the case for the part where the provision has not been initiated.
  • ⑥In the case prescribed by law for the safety of transactions.
(3) In the case of products that cannot be withdrawn according to the provisions of paragraphs (1) and (2), the company shall take measures to prevent the exercise of rights such as withdrawal of subscription by clearly marking them in packages such as goods or other places that members can easily recognize.
(4) Notwithstanding the provisions of Paragraphs 1 to 3, if the content of the paid service is different from the displayed/advertised content or the contract is performed differently, the user must become aware of the fact within 3 months from the date of purchase or the date of availability of the paid service. Alternatively, you can withdraw your subscription within 30 days from the date you could have known.
(5) Members can withdraw their subscription verbally or in writing (including electronic documents) or by e-mail.
9. THE EFFECT OF WITHDRAWAL OF PAID CONTENT
(1) If the member withdraws the subscription, the company will immediately withdraw or delete the member's paid service. Within 7 business days from the date of collection or deletion of the paid service, the payment is refunded in the same way as the payment received. If refund is not possible in the same way, notify in advance. However, in the case of payment methods that require payment confirmation, they will be refunded within three business days from the date of receipt confirmation.
(2) In this case, if the company delays the refund to the member, the delayed interest calculated by multiplying the delay period by the interest rate prescribed by the Consumer Protection Act and Enforcement Decree in Electronic Commerce, Etc.
(3)In terms of refunds, when the user pays with a credit card or the payment method prescribed by the Enforcement Decree of the Consumer Protection Act, The company should immediately apply to the company that provides the checkout method for a request to stop or cancel the payment.If the company has received the payment from the checkout company, it shall refund to the checkout company and notify the user.
(4) If the goods, etc. have already been partially used or partially consumed, the company may charge the member an amount equivalent to the profit obtained by the member from the partial use or consumption of the goods or the cost of supplying the goods, etc.
(5) In case the member withdraws the subscription, the member should pay the cost necessary to return the goods, and the company cannot claim the member for a penalty or compensation for the cancellation of the subscription.
10. REFUND
(1) If a user requests a refund for the Goldwing Cash purchased directly, it can be refunded. In the case of a refund, the goods already supplied must be returned. For reasons such as bank transfer and payment agency fees, 10% or less of the remaining Goldwing Cash will be deducted and the remaining amount will be refunded.However, if the remaining amount of the Goldwing cash is less than 1,000 won, it cannot be refunded.
(2) In the case of subscribed services that can be withdrawn, 10% of the remaining amount will be deducted and refunded, except for the amount already used by the member (the amount used for each product are notified when purchasing the product). However, if the remaining amount of the Goldwing cash is less than 1,000 won, it cannot be refunded.
(3) Refunds may be restricted if the contract is canceled for reasons attributable to the user, such as violation of current laws and important terms and conditions.
(4) Goldwing Cash that the member did not directly purchase for a fee, Goldwing Cash for event given to the member by the company, and Goldwing Cash paid for other rewards are excluded from refund.
11.REFUND OF OVERPAYMENT
(1)If an error occurs in the payment, the company should refund the overpayment amout in the same way as the user's payment. However, if it is impossible to refund in the same way, we will notify you in advance.
(2) If an overpayment occurs due to the company's responsible reasons, the company shall refund the full amount of the overpayment. However, if an overpayment occurs due to the member's responsible reasons, the refund shall be made in the manner prescribed in Article 10.
(3) If the company refuses to refund the overpayment claimed by the user, it must prove that the usage fee has been properly charged.
12. PAYMENT METHOD
(1) Payment methods for the paid services can be made through any of the following methods.
  • ① Payment by mobile phone banking, internet banking, and other account transfers.
  • ② Various card payments such as prepaid cards, debit cards, and credit cards
  • ③ Payment by online deposit without bankbook
  • ④ Payment by electronic money
  • ⑤ Payment by points given by the company, such as mileage.
  • ⑥ Payment by gift certificate contracted with the company or recognized by the company
  • ⑦ Payment by phone or mobile phone
  • ⑧ Payment by other electronic payment methods, etc.
(2) In the case of automatic payment service, in principle, automatic payment is made every month. If normal payment is not made through the payment method designated by the member on the automatic payment date specified when applying for the service, the automatic payment service will be stopped.
13. CONSENT AND PROVISION OF PAYMENT INFORMATION.
Goldwing Cash's charging and paid services can only be used if you agree to provide payment information, and the payment information is provided to the payment agency to provide and settle the paid service.
14. COMPENSATION FOR DAMAGES
If the paid content is damaged or deleted due to a serious defect in the company's own service, the company compensates the member with Goldwing Cash or an equivalent paid service.
15. LIMITATIONS OF COMPANY LIABILITY
(1) The Company shall be exempted from responsibility if the service cannot be provided due to reasons of force majeure such as wars, accidents, natural disasters, national emergencies, technical defects that are difficult to resolve, and existence of government policies.
(2) The Company shall be exempted from responsibility unless there is Company’s intention or gross negligence with respect to use the Goldwing Cash by Users.
(3) The Company shall be exempted from responsibility unless the service is suspended or a failure occurs due to unavoidable reasons such as repair, replacement, periodic inspection, construction, etc.
(4)The Company shall be exempted from responsibility if the suspension of the use of Goldwing Cash or any obstacles to use due to reasons attributable to the user.
(5) The Company shall be exempted from any issues arising from the computer environment of the User or any issues arising from the network environment without intention or gross negligence of the Company.
(6)The Company shall be exempted from responsibility for damages resulting from a dispute between a user and a third party. Therefore, the company does not compensate for the losses caused thereby.
16. CONSUMER DAMAGE COMPENSATION INSURANCE CONTRACT
For the safety of purchase, the company can enter into a consumer damage compensation insurance contract and pay consumer damage compensation according to the consumer damage compensation insurance contract.
17. GOVERNING LAW AND JURISDICTION
These Terms of Cash Policy shall be regulated and interpreted pursuant to the laws of the Korea.
